The Uttar Pradesh Subordinate Services Selection Commission (UPSSSC) is the state agency authorized to conduct the various recruitment examination for appointments to the various vacancies in the departments of UP Government. Few months back, UPSSSC has released a notification for recruitment of Village Development Officer posts. The recruitment process will be done for total 3587 number of Gram Panchayat Adhikari Posts.

UPSSSC VDO Merit List

The UPSSSC Gram Panchayat Adhikari Merit list will be released by the commission at the time of result. Due to huge competition for getting government job in the Uttar Pradesh State, all the candidates are searching anxiously for the merit list. The UP VDO Merit List will contain list of the candidates who have secured marks equal to or more than the cut off marks set by the commission.   6. According to answer key provided by UPSSSC for Gram Panchayat Adhikari I got around 70 marks in OBC category,But i have not selected in the written exam. IS the cut off is very high, or there is something wrong. Is that happend with someone else. please reply.

    Hon’ble Ashwani Kumar Mishra,J.
    1. Petitioner applied for selection to the post of conductor in the respondent corporation as a candidate belonging to Other Backward Caste. In terms of the advertisement issued, petitioner has participated in the written examination, but he is aggrieved by the action of respondents in not calling him for interview.
    2. From the materials, which have been brought on record, it appears that a merit list has been drawn on the basis of provisions contained under rule 8(2)(iii) of the U.P. Direct Recruitment to Group ‘C’ Posts (Mode and Procedure) Rules, 2015, which provides that commission shall draw a separate list for the purpose of calling of candidates belonging to unreserved and reserved category for interview on the basis of their merit. Rule 8(2)(iii), which has been applied by the Commission is reproduced:-
    “8(2)(iii). After the results of the written examination have been received and tabulated, the Commission shall, having regard to the need for securing due representation of the candidates belonging to the Scheduled Castes, Scheduled Tribes and others under rule 6, summon for interview such number of candidates as on the result of the written examination, have come up to the standard fixed by the Commission in this respect. The marks awarded to each candidate at the interview shall be added to the marks obtained by him in the written examination.”
    3. On the basis of aforesaid position, it transpires that the persons, who have secured 220 marks, in the unreserved category have been called for interview, whereas the persons securing 246 or above marks from the Other Backward Caste alone have been called for interview. Similarly, persons securing 242 or above marks from the Scheduled Caste have been called for interview. Petitioner contends that his right to equality qua an unreserved category candidate cannot be violated and he cannot be put to a disadvantageous position qua an unreserved candidate.
    4. A decision of the Division Bench of this Court reported in 2015 (5) ADJ 417 (U.P. Power Corporation Ltd. and another vs. Nitin Kumar and 9 others) is cited at the bar, in which an identical factual scenario cropped up for consideration before this Court. The decision noticed the provisions of section 3(6) of the U.P. Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act 1994, which reads as under:-
    “3(6). If a person belonging to any of the categories mentioned in sub-section (1) gets selected on the basis of merit in an open competition with general candidates, he shall not be adjusted against the vacancies reserved for such category under sub-section (1)”
    5. The issue has been dealt with by the Division Bench in following words in para 8 to 13 of the judgment, which is reproduced:-
    “8. The submission is that the principle which is enunciated in sub-section (6) of Section 3 applies only at the stage of final selection and not at an intermediate stage when a short-list of candidates is drawn up for being called for interview. At the present stage, it has been submitted that the appellants were justified in taking recourse to the process of short-listing by confining reserved category candidates to their own category and necessarily therefore by excluding them from the unreserved category for the purpose of shortlisting. That is the submission which falls for consideration.
    9. Section 3 (6) is a statutory recognition of the principle that if a candidate belonging to a reserved category is selected on the basis of merit in open competition with general candidates, such a candidate is to be adjusted not against the vacancies reserved for the reserved categ
